How it works

Children as passengers change the risk

Carrying students brings higher liability limits, abuse and molestation coverage for drivers and aides, and careful attention to driver hiring and training. School districts and private schools set detailed insurance requirements in their transportation contracts.

School buses in California operate under California Highway Patrol rules for vehicles and driver certification. I place student transportation coverage through a specialty school bus program.

Before you call

What underwriters will ask

Having these ready means I can go to market on the first call. The quote form asks for the same things, and anything you don’t know yet can wait.

Start the Quote Form

  • Fleet: buses and vans with years, capacity and values.
  • Operations: routes, field trips and charters.
  • Drivers: number, certification and experience.
  • Contracts: district or school insurance requirements.
  • Safety: cameras, training and background checks.
  • History: current policies and claims.

School bus, SPAB, or something else

In California the vehicle's category decides which driver certificate, inspection, and equipment rules apply. Underwriters ask the same question, so get the label right first.

  • Schoolbus (Vehicle Code 545). A motor vehicle designed, used, or maintained to carry pupils at or below the 12th grade level to or from a public or private school or school activities. Exceptions include a passenger vehicle designed for and carrying not more than 10 persons including the driver (unless carrying two or more pupils in wheelchairs), certain transit runs open to the public, SPABs, youth buses, and a charter-party vehicle designed for not more than 25 persons when the carrier has no contract with the school or district and the trip does not duplicate school-provided service.
  • School pupil activity bus, or SPAB (Vehicle Code 546). A vehicle other than a schoolbus, run by a common carrier, a public transit system, or a passenger charter-party carrier under a contract between the school and the carrier, carrying pupils to or from a school activity or a residential school. Pupils are picked up and dropped off at off-highway locations where a parent or an adult the parent designates is present.
  • Youth buses and child care motor vehicles. Both fall under the same child safety alert rule as a schoolbus (Vehicle Code 28160). A child care motor vehicle is one designed, used, or maintained for more than eight people, including the driver, and used by a child care provider to transport children.

A charter operator carrying a team to a tournament under a contract with the school fits the SPAB definition. If that is your work, read the charter-party carrier insurance requirements too. Outside California, definitions vary by state.

The certificate every driver must carry

Vehicle Code 12517 requires a schoolbus driver to have, in immediate possession, a license for the appropriate class of vehicle endorsed for schoolbus and passenger transportation, plus a schoolbus certificate when carrying pupils. A SPAB driver needs a license endorsed for passenger transportation and a separate SPAB certificate.

  • Training before the first certificate. Education Code 40082 sets a minimum 40-hour course for an original schoolbus certificate: at least 20 hours in the classroom and at least 20 hours behind the wheel. Education Code 40083 sets a minimum 35-hour course for an original SPAB certificate: at least 15 classroom hours and at least 20 behind-the-wheel hours.
  • Moving up from SPAB. A driver who already holds a SPAB certificate and wants a schoolbus certificate needs at least five classroom hours and three behind-the-wheel hours under Education Code 40082, with some exceptions.
  • Background check. Under Vehicle Code 12517.4, the CHP issues a temporary certificate only after the applicant clears a Department of Justice criminal history check (and an FBI check where applicable) and passes the exams.
  • Five-year term. A certificate is valid for no more than five years, expiring on the fifth birthday after issuance, and can carry restrictions such as automatic transmission only (Vehicle Code 12517.4).
  • No crossover. Vehicle Code 546 says a SPAB certificate does not entitle the holder to drive a schoolbus.

Underwriters want each driver's certificate type and expiration date on the driver list, so fix any lapsed certificate before the application goes out.

The end-of-route check is written into law

Child safety alert system (Vehicle Code 28160). Schoolbuses, school pupil activity buses, youth buses, and child care motor vehicles must have an operational child safety alert system: a device at the interior rear that the driver must manually contact or scan before exiting, prompting an inspection of the entire interior. The general deadline was March 1, 2019. A SPAB is exempt only if every condition in the statute is met, including these:

  • The bus is not used exclusively to transport pupils.
  • At least one adult chaperone selected by a school official rides along, and one chaperone has a list of every pupil and adult aboard at departure.
  • The driver reviews safety and emergency procedures before the first departure, and the driver and chaperone sign a dated, timed form.
  • Immediately before departing any location, the chaperone accounts for every pupil, verifies the count with the driver, and signs a form.
  • After pupils exit and before driving away, the driver checks all areas of the bus, including overhead compartments and bathrooms, and signs a dated, timed form.
  • The school keeps those forms for at least two years.

Transportation safety plan (Education Code 39831.3). County offices of education, school districts, charter schools, and private schools that provide transportation must have a plan covering when pupils need an escort, boarding and exiting, procedures to make sure a pupil is not left unattended on a schoolbus, SPAB, or youth bus, and standards for designating SPAB chaperones. Each school keeps a current copy and must make it available to a CHP officer on request.

If you contract with schools, match your driver procedures to their plan. Underwriters ask how drivers complete the end-of-route check and who audits it, and an abuse and molestation application asks similar supervision questions.

Inspections and safety drills: the paper trail

Annual CHP inspection (Vehicle Code 2807). The CHP must inspect every schoolbus at least once each school year to check that its construction, design, equipment, and color comply with the law. No one may drive a schoolbus unless a CHP inspection certificate is displayed inside it, showing an inspection date within 13 months of the day the bus is operated.

Passenger safety instruction (Education Code 39831.5). The county superintendent, district superintendent, or private school owner or operator must make sure pupils who ride a schoolbus or SPAB get:

  • Written safety information at registration for parents of first-time riders in prekindergarten through grade 6, including nearby bus stops, conduct at loading zones, red light crossing, the danger zone, and walking to and from stops.
  • Instruction at least once each school year for prekindergarten through grade 8 pupils who ride home-to-school, covering loading and unloading, crossing, restraints, conduct, and evacuation, including an evacuation through the emergency exit doors.
  • Instruction before departure on every school activity trip by schoolbus or SPAB, covering the location of emergency exits and the location and use of emergency equipment.
  • A record of each annual session (school, date, supervising adults, number and grades of pupils, subjects, time taken, driver name, bus number), kept on file for one year and subject to CHP inspection.

I send current inspection certificates and the latest drill records with the vehicle schedule. For the vehicles themselves, see commercial auto insurance; when a contract calls for higher limits, see commercial umbrella insurance.

Questions

School bus insurance, answered

Why do school bus operators need abuse coverage?

Drivers and aides are alone with children, and abuse allegations are excluded from many auto and liability policies unless added.

What limits do districts require?

Contracts set them, and they're usually higher than standard commercial auto limits. Send me the contract and I'll match it.

Can private schools insure their own buses?

Yes. Schools that run buses can insure them under a student transportation program or their school package.

What do underwriters rate on?

Fleet size and type, routes, driver history, safety programs and claims history.

Does a 15-passenger van count as a school bus in California?

It can. Vehicle Code 545 exempts a passenger vehicle only if it is designed for and carrying not more than 10 persons, including the driver, so a larger van carrying pupils to or from school or school activities is a schoolbus unless another exception in the statute applies.

How long is a California school bus driver certificate valid?

Under Vehicle Code 12517.4, a certificate is valid for a maximum of five years and expires on the fifth birthday after issuance of the original or expiration of the certificate renewed.

Do you offer school bus insurance outside California?

Yes. Clients across the country send the same quote form. Sam Alishahi is licensed in all 50 states and Washington, DC and places policies there directly. The shopping across carriers works the same way. Rules, minimums and markets differ by state — see truck insurance by state or insurance requirements by state.
