How it works

Garagekeepers is the coverage shops miss

General liability doesn't cover damage to customers' cars in your care. Garagekeepers coverage does, whether the damage happens in the booth, on the lot or on a test drive.

Body shops also carry fire risk from paint booths and pollution exposure from solvents. I place collision, paint and restoration shops with carriers that write the class.

Before you call

What underwriters will ask

Having these ready means I can go to market on the first call. The quote form asks for the same things, and anything you don’t know yet can wait.

Start the Quote Form

  • Shop: address, square feet and years in business.
  • Work: collision, paint or restoration.
  • Booths: number of paint booths.
  • Customer cars: how many at once and their values.
  • Payroll: technicians and office staff.
  • History: current policies and loss runs.

The federal paint booth rule: 6H in every state

EPA's area-source rule for surface coating, 40 CFR part 63 subpart HHHHHH, covers autobody refinishing, meaning spray-applied coating of motor vehicles and mobile equipment. It even reaches an individual who spray-coats more than two vehicles a year, paid or not. Section 63.11173 sets the shop-floor rules:

  • Filters. Every spray booth, prep station and mobile enclosure needs filters shown to capture at least 98 percent of overspray. Water-wash booths run and maintained to the manufacturer's specifications are excepted.
  • Enclosure. Booths and prep stations used to refinish complete vehicles need a full roof, four complete walls or side curtains, and negative pressure that draws air in through any openings; a fully sealed booth with automatic pressure balancing may run up to 0.05 inches water gauge positive.
  • Guns. HVLP, electrostatic, airless or air-assisted airless, or an equivalent EPA approves in writing.
  • Gun cleaning. No atomized mist of solvent and paint outside a collecting container: hand cleaning, flushing without atomizing, or a fully enclosed gun washer.
  • Painters. Training and certification within 180 days of hire, refresher training and recertification every five years, and a current list of everyone required to be trained. People who aren't certified may not spray.

State and local air agencies add their own permits and rules. When I put a body shop in front of carriers, the painter certification list goes in the file with the booth details.

Southern California: Rule 1151 and the booth permit

Inside the South Coast AQMD, Rule 1151, Motor Vehicle and Mobile Equipment Non-Assembly Line Coating Operations, applies to anyone who uses or applies automotive coatings in the district, and its definition of an automotive refinishing facility names autobody collision repair shops. As amended November 1, 2024:

  • Phase II VOC limits. They take effect January 1, 2028 for single-stage coating, epoxy primer, adhesion promoter and pretreatment wash primer; January 1, 2029 for primer sealer and primer surfacer; and January 1, 2030 for color coating, tinted mid-coat and gloss clear. A coating made before its limit takes effect, and within the limit in force when it was made, can be sold for 24 months and used for 36 months after that date.
  • Application. Electrostatic spray; HVLP, which the rule defines as 0.1 to 10 psig atomizing pressure measured at the air cap and air horns; brush, dip or roller; or another method shown to match HVLP's transfer efficiency and approved in writing first.
  • Records. Kept under Rule 109: product and manufacturer, application method, coating category and mix ratio, VOC content, data sheets, and purchase records showing total volume used. Solvent cleaning follows Rule 1171.
  • Permits. Rule 201 requires written authorization before you build, install, alter or replace equipment that may emit air contaminants, and Rule 203 a permit to operate it, run within the permit's conditions. Under Rule 206 the entire permit goes on the equipment, or within 8 meters (26 feet) of it when it can't be affixed.

If you added or replaced a booth since your last renewal, the permit and the application should describe the same equipment.

Painters' lungs: Cal/OSHA booth and respirator rules

In California, Title 8 section 5153 sets the booth rules for spray coating. Mechanical ventilation runs while spraying and long enough afterward to exhaust flammable vapors from drying work, and it must keep those vapors under 20 percent of their lower explosive limit. Exhaust air can't be recirculated, make-up air should be supplied, no make-up air heater may sit in the booth, and downdraft booth doors stay closed while painting. A booth operator positioned downstream of the object being sprayed must wear a respirator, and that use must meet section 5144, which requires:

  • A written respiratory protection program with worksite-specific procedures, run by a qualified program administrator.
  • Respirators, training and medical evaluations at no cost to the employee.
  • A medical evaluation before the employee is fit tested or required to use the respirator.
  • For tight-fitting facepieces, a fit test before first use, whenever a different facepiece is used, and at least annually.
  • Training before required use, and retraining annually.

Outside California, the rules vary by state. With a body shop's workers' compensation insurance submission I include the written program, because painters are the employees the underwriter reads about first.

Paint waste and booth fires: what to read for

California's hazardous waste generator rules in Title 22 cover a shop shipping spent solvent and paint waste; the ID number and small quantity generator sections became operative July 1, 2024. Rules vary by state.

  • ID number. Under 66262.18 a generator can't treat, store, dispose of, transport or offer hazardous waste for transport without a U.S. EPA ID number from the Department of Toxic Substances Control, applied for on EPA form 8700-12. Small quantity generators of RCRA waste re-notify starting in 2024 and every four years after, by September 1.
  • Storage. Under 66262.16 a small quantity generator holds waste no more than 180 days (270 if it must ship 200 miles or more) and never over 6,000 kilograms. Containers are marked "Hazardous Waste" with the contents, hazards, generator's name and address, and accumulation start date, and the emergency coordinator's name and number are posted by the phones.
  • Manifests. Sign the generator certification, get the transporter's handwritten signature and date, and send the Department a legible copy within 30 days of each shipment (66262.23). Keep records three years (66262.40).

On the liability side, IRMI's commentary says the waste portion of the CGL pollution exclusion has no exceptions, while the premises portion keeps an exception for injury or damage from a hostile fire's heat, smoke or fumes. When I review a body shop's liability quote, I read for whether an endorsement removes that exception, and if the policy is a garage form, I read that form's own pollution wording. Waste goes to pollution liability.

Questions

Auto body shop insurance, answered

What is garagekeepers coverage?

It covers damage to customers' vehicles while they're in your care, custody or control, such as fire, theft or a technician's accident.

Does general liability cover a customer's car?

Usually not. That's what garagekeepers is for.

Is my paint booth a problem for carriers?

Booths are common in the class. Carriers look at booth construction, fire suppression and cleaning.

Do I need pollution coverage?

Many shops add it for paint, solvents and waste, which general liability often excludes.

Does a body shop need an EPA ID number in California?

If it generates hazardous waste, yes: 22 CCR 66262.18 bars a generator from storing, shipping or offering that waste for transport without a U.S. EPA ID number from the Department of Toxic Substances Control, applied for on EPA form 8700-12.

Does SCAQMD Rule 1151 apply outside Southern California?

No. Rule 1151 applies to coatings used within the South Coast AQMD. Autobody refinishing everywhere falls under federal 40 CFR part 63 subpart HHHHHH, which sets booth, spray gun and painter training rules.

Is a body shop responsible for work it sublets?

In California, yes. Business and Professions Code 9884.9(b) requires the written estimate to list any service someone other than the shop or its employees will do, bars that work without the customer's consent unless the customer can't reasonably be notified, and makes the shop responsible for it as if its own employees did it.

Do you offer auto body shop insurance outside California?

Yes. Clients across the country send the same quote form. Sam Alishahi is licensed in all 50 states and Washington, DC and places policies there directly. The shopping across carriers works the same way. Rules, minimums and markets differ by state — see insurance requirements by state.
